Battery Waste Management Authorisation
Who all shall apply for Battery Waste license?
All entities dealing and handling batteries will require to apply for Battery Waste license. In order to abide by the rules mentioned in battery waste management.
The below mentioned persons have to compulsorily apply and get battery waste license.
- Manufacturers, Assemblers and Re-conditioners
- Importers
- Dealers
- Bulk Consumers (Government departments)
- Auctioneers
- Consumers
- Recyclers
What is the need to apply for license?
The Waste Management Act 1996 as amended requires that any industry involved in the recovery or disposal of waste shall hold a License for the same, which permits industries to conduct the treatment/storage/recycling/recovery or disposal of waste. To access permission by the authority it is necessary to apply for license.
What all documents required for Battery Waste Management?
General documents like: –
- Aadhaar Card
- PAN Card
- Rent agreement or proof of ownership
- Electricity Bill
- PAN Card of business entity (Proprietor, Partnership, Company)
- Authorization letter in favour of applicant (not required for proprietorship concern)
- MAP/Layout Plan
- GST Certificate
- Certificate of Incorporation
- Pollution Consent
- Hazardous Waste Authorization
- Certificate of registration with District Industries Centre; and
- Proof of installed capacity issued by either State Pollution Control Board/ District Industries Centre
Under Batteries (Lead Acid Batteries) Waste Management in Delhi, certain responsibilities are introduced for every category to be complied with.
Starting with Manufacturers
They must ensure collection of used batteries.
- Build individual or joint centers at different places for collecting used batteries from consumers or dealers and ensuring no damage while transporting the batteries is caused to the environment.
- Making sure that used batteries are transported only to the assigned registered recyclers.
- Creating Public Awareness through posters, advertisements, publications etc. about hazards of lead and the consumer’s responsibility. Also informing the public, the name and address of dealers and collection centres.
- To buy recycled lead from registered recyclers only. And inform DPCC or Ministry of Environment and Forest is any violation occurred by dealers.
- Ensure all the new batteries must be sold to registered dealers and use international recycling sign on the batteries.
Assemblers and Re-conditioners
- They must ensure collection of used batteries.
- Making sure that used batteries are transported only to the assigned registered recyclers.
- Creating Public Awareness through posters, advertisements, publications etc. about hazards of lead and the consumer’s responsibility. Also informing the public, the name and address of dealers and collection centres.
- To buy recycled lead from registered recyclers only. And inform DPCC or Ministry of Environment and Forest is any violation occurred by dealers.
Manufacturers, Assemblers & Re-conditioners have to file half-yearly returns in Form-1 by 30th June and 31st December, every year.
For Importers
- To get registered with Central Pollution Control Board (CPCB) by filing details in Form-II.
- Shall have valid registration with Reserve Bank of India (RBI).
- To submit an undertaking in Form-III with DPCC.
Importers have to file half-yearly returns in Form-1 by 30th June and 31st December, every year.
Dealers
- To be registered with DPCC by filing Form-IV.
- Making sure collection of used batteries.
- Provide consumers with suitable discounts for every returned battery.
- Confirming safe delivery of used batteries to collection centres or recyclers.
- Ensuring no damage is caused to the environment while transportation and storage of used batteries.
Dealers must file half yearly returns in Form-1 by 30th June and 31st December, every year.
Bulk Consumers
(Includes Departments of Central Government like Railways, Defence, Telecom, Posts and Telegraph, Departments of State Government, Undertaking, Boards, other agencies or companies purchasing hundred or more than hundred batteries per annum)
- To make sure that used batteries are disposed of by depositing it to dealers/ manufacturers/ registered recyclers/ Importer/ re-conditioner or at collection centres.
Bulk Consumers must file half yearly returns in Form-VIII by 30th June and 31st December, every year to DPCC.
Auctioneers
- To make sure used batteries are auctioned to registered recyclers only.
- Keep proper records of such auction and making it available for inspection to DPCC.
Auctioneers have to file half yearly returns of auction in Form-IX by 30th June and 31st December, every year to DPCC.
Consumers
- Ensuring used batteries are disposed of by depositing it to the assigned collection centres or any other registered re-cyclers, re-conditioners.
Recyclers
- Recyclers must apply for registration to the Ministry of Environment and Forests or an agency designated by it if not applied before, in Form VI.
- Complying strict compliances of terms and conditions of registration.
- Mark “Recycled” on lead recovered by reprocessing.
- Conducting Public Awareness through advertisements, publication, posts about hazards leads and the consumers responsibility for returning used batteries only to the registered dealers or designated collection centres.
Recyclers to submit Annual Returns as per Form VII to State Pollution Control Board.
IMPORTANT NOTE: As per the Annexure III of Master Plan of Delhi – 2021, lead manufacturing including secondary lead industry (which includes recovery of waste scrap) is PROHIBITED in NCT of Delhi. |
NON-COMPLIANCE PUNISHMENT:
Any violation of the provisions of Rules under the Environment (Protection) Act, 1986 indicates Imprisonment for a term which may extend to five year sand Fine up to One Lakh rupees or both.
