    INTRODUCTION

    The Employee State Insurance Act, 1948 has emerged to provide various health related benefits to all the employees working in a factory. These health benefits provided under the Employees State Insurance Scheme are legally known as “Social Security”.

    The ESI Act, being the first major legislation on social security was introduced for the benefit of all the workers working in factories.

    The Act came with a purpose to protect the interest of workers in case of bad heath issues of the employees like in case of sickness, maternity, temporary or permanent disablement, death due to employment injury etc.

    BENEFITS

    There are in total 6 social security benefits provided to all the employees working in factory/shop/establishment. The 6 major benefits are as follows:-

    1. The first benefit provided under ESIC is “Medical Benefit”. From day one itself of the employment, the employees are entitled to all the insured medical expenses that are affordable and reasonable. Full medical care is provided not only to the insured person but also to his or her family members.
    2. The next benefit which is necessary for employee’s wellness is “Sickness Benefit” (SB).This benefit is further been divided into two benefits namely:-Extended Sickness Benefit (ESB) Enhanced Sickness Benefit. This benefit can be availed when the employee is on medical leave and for two consecutive period. This scheme allows cash flow during the said period as under it, the worker is eligible to claim 70% of the daily wage for a maximum of 91 days.
    3. Furthermore, the next benefit is specifically for pregnant ladies working in a factory or shop or establishment, that is “Maternity Benefit”. Under the scheme, women are allowed to avail 100% of the daily wage up to a period of 26 weeks. Also, this period can further be extended to one month if medically advice.
    4. In addition to this, the fourth benefit includes “Disablement Benefit”. Under this benefit, there are two other categories under it, namely:-Temporary Disablement Benefit (TDB) and Permanent Disablement Benefit (PDB). If we talk about temporary disablement then, the worker suffering for the same shall be eligible for a monthly wage of 90% until they recover it. Whereas in case of permanent disablement
    5. The fifth benefit is the “Dependent’s benefit“(DB). It is beneficial for the dependents who are eligible to receive benefits when the recipient retires, becomes disabled or dies.
    6. The last benefit includes other benefits. Other benefits is categorized into two division namely:
      –Funeral Expense: an amount of Rs 15000/- shall be provided to the person performing last rite of the employee registered under the scheme.
      –Confinement Expense: these expenses are granted to all the insured women in case medical facilities under ESIC are not available.

    WHO REQUIRES?

    ESIC Registration is a mandatory registration for all the factories and establishments having 10 or more permanent employees having maximum salary of Rs. 21,000/- within the 15 days time period from the date of applicability.

    As per Section 1(5) of the ESI Act, there are some specified entities that are covered under this scheme. The entities covered are as follows:-

    • Shops
    • Restaurants or hotels engaged in sale
    • Cinemas
    • Road motor transport establishments
    • Newspaper establishment (not falling under Factories Act)
    • Private medical institutions
    • Private educational institutions

    All these entities are required to get ESIC Registration when the entities employ 10 or more persons, the owner/ employer

    2. Registration Certificate (in case of partnership firm or a company)
    3. Article of Association (AOA) of the company
    4. Memorandum of Association (MOA) of the company
    5. List of employees working in the establishment
    6. Compensation details of all employees
    7. PAN Card details of Business Entity
    8. PAN Card details of all employees
    9. Cancelled cheque
    10. List of shareholders and directors of the company
    11. Register having attendance details of all its employees
    12. Employer’s Registration Form (Form No. 1)

    UPDATES

    Registration for EPFO & ESIC for new Public & Private Limited Companies and One Person Company has been stopped on Shram Suvidha Portal from 08.10.2020.

    With effect from 08.10.2020, new Public & Private Limited Companies and One Person Company shall get registration number for EPFO & ESIC on MCA portal (www.mca.qov.in through Spice+ and AGILE-PRO eforms) only at the time of incorporation.

    However, the above new companies will have to comply with the provisions of EPF & MP Act, 1952, and ESI Act, 1948 when they cross the threshold limit of employment under the respective Acts.

    Note: The draft versions in list below will be removed after 30 days from last updated date.

    Note: No physical documents are to be submitted to EPFO and ESIC office for registration and also no physical visit is required. All the documents are to be uploaded online only at the time of filling application for registration.

    A unique 17 digit Identification Number that is provided to each of the beneficiaries of the scheme.  The ESIC code number is generated by the ESIC portal.
