The Goods and Services Tax Act passed in the Parliament on 29th March 2017 and came into effect on 1st July 2017 has prescribed a time period and in the prescribed period itself the change of address shall be made.
Within a period of 15 days of the occurrence of the event of address change, all the changes regarding address proof must be updated on the GST Online Portal. The application made for updating the address would be approved within 15 days if the concerned officer is satisfied with the application submitted. And if not satisfied then, a notice is served to the applicant for fulfilling the officer’s requirement and within a period of 7 days, the taxpayer is expected to respond. It is completely on the officer to either approve the application or to reject it.
However, is the GST officer doesn’t act within the 15 days’ time period then, it will be deemed that the approval for the grant of address change has been granted.
GST FORM REG-14 is the form required to be submitted when the principal place of business’s address is to be changed or maybe updating the previous address. Being state-based registration, the state is a very important aspect. If state is changed, then old registration must be cancelled and new registration another state shall be done. For proof to be submitted, proof of address must be provided in the GST registration amendment application.
Following are the proof of address required to submit: –
Owned property proof like latest property tax receipt or municipal khata copy or electricity bill in case of owned property premise.
Valid rent agreement or lease agreement and along with it, ownership of the premises of the Lessor like proper tax receipt or municipal khata copy or electricity bill.
In case of non-availability of rent agreement, an affidavit to that effect along with any document in support of the possession of the premises like electricity bill shall be provided.
Where the premises not falling under any of the above-mentioned category then, a copy of the consent letter with any document for ownership proof of the Consentor like municipal khata or electricity bill copy shall be considered as a valid proof.
If the principal place of business is located in SEZ i.e. Special Economic Zone or the applicant is a SEZ developer then, the necessary documents and prescribed certificates issued by the Government of India are required to be uploaded.
