How to get Plastic Waste Management Authorisation

What is PWM Authorisation?

Under Plastic Waste (Management and Handling) Rules, 2016, the Union Ministry of Environment, Forests and Climate Change has provided with a regulatory framework for managing plastic waste generation.

Section 5 of Environment (Protection) Act, 1986 is the act governed for Plastic Waste Management which issues to all States/Union Territories for setting up institutional mechanism for strengthening Plastic Waste Management (PWM).

Plastic being the biggest problem in today’s time has populated our country immensely. For solving it, the prescribed rules formed under Plastic Waste (Management and Handling) Rules has provide a framework that helps in management of plastic waste generated by households, industries and other manufacturing units. Plastic Waste Management (PWM) is an approach to minimize plastic waste hampering the environment and to develop appropriate measure for disposal of plastic garbage.

Who requires registration of Plastic waste license?

As per PWM Rules, authorization is applicable on:

  1. Every waste generator
  2. Local bodies
  3. Gram Panchayat
  4. Brand Owners
  5. Importers
  6. Producers

In short, all those dealing or in connection with plastic waste or plastic products generation, production or manufacturing are required to get Plastic Waste NOC.

List of documents required for PWM Consent

  1. Copy of valid consent/ receipt of an application for consent.
  2. MSME Certificate or Registration Certificate (Unit registered with District Industries Centre of the State Government or Union Territory).
  3. List of raw materials, by products and products with quantum (by weight) per year.
  4. List of individuals supplying plastic to be used as raw material with quantity (in weight/ day) to manufacture carry bags or plastic sheet of like or multilayered packaging.
  5. Flow diagram of manufacturing process
  6. EPR Action Plan (in case of Producers)
  7. Analysis report of ETP/ emission test report (if applicable)

Procedure of getting Plastic Waste Management registration for recyclers

  1. Filing of application

Every recycler shall make an application to the State Pollution Control Board or the Pollution Control Committee for the grant of registration or renewal of registration for the recycling unit in Form II.

  1. Preparation of documents

Preparing and drafting of all the necessary documents will be required for the process of registration for plastic waste management license. It is genuinely advised to consult a DPCC CONSULTANT for processing registration under Plastic Waste Management Rules. Otherwise, any unintended fault done by you may lead to fraudulent conduct and closure of your business too.

  1. Inspection by concerned officer before issuances of authorization

The State Pollution Control Board or the Pollution Control Committee shall not issue or renew registration to recyclers or any manufacturing unit unless they have valid consent approved under Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 and also a certificate of registration issued by the District Industries Centres or any other Government agency authorised.

Officer will ensure that recycler and manufacturing units possesses required facilities, technical capabilities and equipment to handle plastic waste safely and will grant registration after all the requirements are fulfilled.

  1. Issuance of authorization by department

After reviewing the application made for registration, the designated officer will take decision and then will issue the plastic waste management authorization certificate to the applicant.

Procedure of getting plastic waste management registration for manufacturers

  1. Filing of application

Every manufacturer engaged in manufacturing of plastic used as raw material by producer shall have to make an application to State Pollution Control Board or the Pollution Control Committee of the Union territory concerned, for grant of registration in Form-III.

  1. Preparation of documents

Preparing and drafting of all the necessary documents will be required for the process of registration for battery waste management license. It is genuinely advised to consult a DPCC CONSULTANT for processing registration under Plastic Waste Management Rules. Otherwise, any unintended fault done by you may lead to fraudulent conduct and closure of your business too.

  1. Inspection by concerned officer before issuances of authorization

The State Pollution Control Board or the Pollution Control Committee shall not issue or renew registration to manufacturer unless they have valid consent approved under Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 and also a certificate of registration issued by the District Industries Centres or any other Government agency authorised.

Procedure of getting Plastic Waste Management registration for producer/ Importer/ brand owner

  1. Filing of application

No producer, importer, brand owner shall manufacture carry bags or recycle plastic bags or multi-layered packaging unless registration from the State Pollution Control Board or the Pollution Control Committee of the Union Territory concerned, prior to the commencement of production.

  1. Preparation of documents

Preparing and drafting of all the necessary documents will be required for the process of registration for battery waste management license. It is genuinely advised to consult a DPCC CONSULTANT for processing registration under Plastic Waste Management Rules. Otherwise, any unintended fault done by you may lead to fraudulent conduct and closure of your business too.

  1. Issuance of authorization by department

After reviewing the application made for registration, the designated officer will take decision and then will issue the plastic waste management authorization certificate to the applicant.

Responsibility of waste generator under PWM Rules

  • The waste generator shall take steps to minimize generation and segregation of plastic in conformity with the Solid Waste Management Rules, 2000. The waste generator must not litter the plastic waste and ensure a segregated storage of waste at source and handover segregated waste to urban local body or gram panchayat or agencies appointed by them or registered waste pickers.
  • Institutions generating plastic must segregate and store the waste in accordance with the Municipal Solid Waste (Management and Handling) Rules, 2000 and afterward transport it to waste collecting agency.
  • Waste generator has to pay fee or charge as mentioned in bye-laws for plastic waste management.

Any person who organizes an event in open space involving food commodities packed in plastic or multi-layered packaging shall segregate and manage the waste generated during the event taking place in accordance with the Municipal Solid Waste (Management and Handling) Rules, 2000.

Responsibilities of producers, Brand Owner, Importer NOC for Plastic Waste

  1. The producer shall work on modalities for waste collection system based on ERP within six months from the date rules introduced.
  2. Producers, importers and brand owners who introduce the product in the market hasprimary responsibility to collect used multi-layered plastic sachets or pouches or plastic packaging. After collecting, they are required to establish a system for collecting the used plastic or plastic waste and to submit it to the State Pollution Control Board. Along with it, a consent to Establish or Operate or Renewal is needed.
  3. Producer within a period of three months shall apply to The State or the Union Territories administration concerned, for grant of registration.
  4. No producer shall on and after expiry, manufacture or use any plastic or multi-layered packaging without valid registration.

Every producer has to maintain and keep records of the persons engaged in supply of plastic used as raw material to manufacture carry bags or plastic sheet or plastic covers.

Annual compliance under PWM Rule 

  1. Form-IV: to be filed by every person engaged in recycling or processing plastic waste shall prepare and submit annual report in the prescribed form to the State Pollution Control Board.
  2. Form-V: filed by every local body, to the concerned Secretary-in-charge of the Urban Department.
  3. Form-VI: each State Pollution Control Board or Pollution Control Committee to CPCB.

The CPCB shall prepare a consolidated annual report on usage and management of plastic waste and forward it to Central Government.
