Responsibilities under E-Waste Management Rules

Meaning of Manufacturer

Manufacturer is a person or a company as defined in the Companies Act, 2013 or a factory as defined in the Factories Act,1948 or Small and Medium Enterprises as defined in Micro, Small and Medium Enterprises Development Act, 2006 who has all the facilities of manufacturing of electronic items and materials.

Responsibilities of Manufacturers under e-waste management rules

  • Every manufacturer has to collect e-waste generated during the manufacturing of electronic items and transfer it for recycling or disposal purposes.
  • A manufacturer has to apply for authorization in Form 1 (a) from the State Pollution Control Board.
  • Manufacturers must be ensured of the safe storage and transportation of e-waste so that no harm is caused to the environment.
  • Every manufacturer has to maintain records of the amount of e-waste generated, handled, and disposed in Form-2 and make it available for scrutiny by State Pollution Control Board.

And lastly, the annual compliance, file an annual return in Form 3 to State Pollution Control Board before 30th June of the following year.

Meaning of Dismantler under e-waste management rules

Dismantler is a person or a company having a business of dismantling used electronic materials, equipment.

Responsibilities of Dismantlers under e-waste management rules

  • To ensure the dismantling process is according to the guidelines as prescribed in the electronic waste management rules.
  • Every dismantler shall obtain authorization from the State Pollution Control Board.
  • To avoid any kind of damage caused to the environment while transporting the used e-waste to the collection center.
  • To make sure that e-waste is segregated and sent to the authorized recycler.
  • Dismantler shall send non-recyclable items to the authorized treatment storage.
  • File Form-2 to maintain records of the e-waste collected, dismantled including the e-waste sent for recycling.
  • A dismantler has to file an annual return in Form-3 on or before 30th June following the financial year to the concerned State Pollution Control Board.
  • No dismantler shall process any e-waste for recovery or refining of materials unless authorized by the SPCB

And if the operation is done by the dismantler without authorization, it will be considered as causing harm to the environment.

Meaning of Recycler under e-waste management rules

Recycler a person engaged in recycling and reprocessing of waste electrical and electronic equipment or in assembling components. Having all facilities mentioned in the guidelines of the Central Pollution Control board.

Responsibilities of Recyclers under e-waste management rules

  • Every recycler has to ensure that the recycling process is being initiated as per the guiding prescribed by the authority concerned.
  • No damage shall be caused to the environment while transporting and storing process of e-waste.
  • To file and maintain records for making it available for inspection by the Central Pollution Control Board.
  • Recycler has to file Form-2 to keep a record of the e-waste collected, dismantled, recycled.
  • Every recycler shall file an annual return in Form-3 on or before 30th day of June every year.
  • Recyclers may accept waste electronics, electronic equipment’s not listed in Schedule I for recycling provided they must not contain radioactive material and indicate it while taking authorization from the concerned State Pollution Control Board.

Any operation done by recycler without authorization will be considered as a violation of the rules leading the harm to the environment.

Meaning of Refurbisher under e-waste management rules

Refurbisher is a company or undertaking registered under the Factories Act, 1948 or the Companies Act, 1956 or district industries center engaged in the refurbishment of used electrical and electrical types of equipment.

Responsibilities of Refurbishers under e-waste management rules

  • Refurbisher shall collect e-waste generated during the process of refurbishing and channelize it to authorized recyclers.
  • Every refurbisher shall make a one-time application in Form 1(a).
  • Making sure that no damage is caused to the environment while channelizing the used e-waste.
  • Refurbisher should be concerned about the refurbishing process which shall not have any adverse effect.
  • Annual return to be filed in Form-3 by refurbisher on or before 30th day of June of the following year.
  • To keep records of the amount of e-waste handled in Form 2 for scrutiny by the authorized authority.
