    INTRODUCTION

    The Delhi Shops and Establishment Act 1954 is an act formulated by Government of N.C.T of Delhi and is applicable to whole of India. However, every state and union territory describe its own act to govern entities falling within the state’s area/ boundary except the general provisions which are similar to all the states.

    Objective of Delhi Shops Act and Establishment Act 1954 has come up with to regulate and enhance the employment conditions of the workers employed in shops and establishments including commercial establishment.

    The Delhi Shops and Establishments Act defines a “shops” as “shop” means any premises where goods are sold either by retail or wholesale or whole services are rendered to customers and includes an office, a store room, godown, warehouse or workhouse or workplace, whether in same premises or otherwise, used in or in connection with such trade or business but does not include a factory or commercial establishment.     HOURS OF WORK IN DELHI

    As per the provision of the Shops and Establishments Act 1954 of Delhi, no adult shall be allowed to work for more than nine hours on any day or 48 hours in any week. And if any employer ask the adult to work for more than nine hours in a day then, it is the responsibility of the employer to pay the employee the overtime wage.

    Also, no employee shall be allowed to work for more than five hours before the employee has a break for meal of atleast half an hour.

    In the state of Delhi, no child is eligible to work in an establishment notwithstanding that such child is a member of the family of the employer. Also, the shops and establishment does not permit young person to work about the business or an establishment for more than six hours a day.

The imprisonment for a term not exceeding three months shall be applicable.
