Ban on Single Use Plastic

The latest update made by Delhi Pollution Control Committee is for all the entities engaged as producers, importers, brand owners (PIBOs), manufacture, stocking, distribution, sale and use of carry bags, plastic sheets or like or covers made of plastic sheet and multi-layered packaging and Plastic Waste Processors (Recycling, Co-processing, waste to energy, waste to oil etc.)

In addition to it, an amendment has been notified in PWM Rules dated 12.08.2021 which states:-

  • Thickness of carry bags made of virgin or recycled plastic shall not be less than Seventy Five (75) microns w.e.f 31st December, 2021.
  • Sachets using plastic material shall not be utilized for storing, packing, or selling gutka, tobacco and pan masala;
  • The weight of the non-woven plastic carry bags shall not be less than 60Gram per sq. meter (GSM) w.e.f. 30th September,2021.
  • The manufacture, import, stocking, distribution, sale and use of following single use plastic, along with polystyrene and extended polystyrene, commodities shall be prohibited with impact from the 1st July, 2022:-
  1. a) Ear buds with plastic sticks, plastic sticks for balloons, plastic flags, sweet sticks, ice-cream sticks, polystyrene for decoration;
  2. b) Plates, cups, glasses, cutlery such as forks, spoons, knives, straw, trays, wrapping or packing motion pictures round candy boxes, invitation cards, and cigarette packets, plastic or PVC banners much less than a hundred micron, stirrers (not practice to commodities made of compostable plastic).
  • Manufacture and use of multi-layered plastic that is non recyclable or non energy recoverable or with no alternative use of plastic is any should be phased out in two years’ time.

PIBOs, as per the MOE&F notification, are required to fulfill the ERP i.e. Extensible Producers Responsibility for the plastic waste generated for the products used. All PIBOs including other industries or individuals using plastic sheets or covers made of plastic sheets and Plastic Waste Processors (recycling, co-processing, waste to energy, waste to oil etc) are also directed to follow and comply with the rules and regulations as stated under the Plastic Waste Authorization Management (Amendement) Act, 2016.

Where there is non compliance made by any, action shall be taken which shall lead to closure of the unit, disconnection of electricity/wall supply including levying of Environmental Compensation.

The existing registration shall be aligned with the SOP within three months of issue of SOP for which registered PIBO shall resubmit the application online with the relevant information and processing fee.
