With such an amazing footfall, it becomes an equally attractive venture to start off as a business for some long-term money, and obtaining a DPCC license for the same becomes a necessity.

Before the process comes the Parking Standard as per Master Plan Delhi 2021.

As per Master Plan Delhi, parking is one of the utilities permitted in all zones except in regional park/ridge, developed recreational areas and parks as per the approved layout plan. Parking standards have been prescribed in each use premises and where not mentioned about parking standard, these will be followed as per standards given in Development code section of the Master Plan. The standards given are in Equivalent Car Space (ECS) which include parking for all types of vehicles i.e cars, scooters, cycles, light and heavy commercial vehicles, buses etc. Parking adequacy statement/study for large projects like Stadia, Shopping Malls, Multiplexes will be desirable.

What is DPCC Pollution License?

The new establishing units are required to obtain consent under the Water Act, 1974 and Air Act,1981 before starting with the production process.

In general sense, any industry or establishment that can potentially affect the environment with pollutants with the discharge of waste in water or air, needs to obtain consent from the state pollution control board, which acts as the sole authority to issue the consent for the operations of the industry. This consent is given the name of “Pollution License”.

Category-wise classification of Malls under DPCC

  1. Shopping Malls, Housing / Commercial/ Office Complexes having built-up area 20,000 sqm and above, covered under Red Category of DPCC.  DPCC office order classification is II(a). Applicant is required Pollution Control Device for Effluent (STP/ETP/O & G Trap etc.
  2. Shopping Malls, Housing / Commercial/ Office Complexes having a built-up area less than 20,000 sqm, covered under Orange Category of DPCC. DPCC office order classification is II(b). Applicant is required Pollution Control Device for Effluent (STP/ETP/O & G Trap etc.

Process of DPCC registration for malls

Step 1: Find a location

Location plays a big role as the business profits depend on it. With a location having a good atmosphere and the other required facilities, it will be easy for your business to scale up.

However choosing a location to run a long-term business is not a quick task, instead proper time and research shall be required before beginning with mall set up.

Step 2: Delhi Pollution Control License Authorisation for malls

Documents required for Pollution NOC for malls are:

  • Aadhaar Card of applicant
  • Authorisation in favour of applicant
  • MSME Registration (not mandatory)
  • Pan Card of the entity
  • Electricity bill (if any)
  • Water Bill (if ground water, authorization required)
  • CA Certificate
  • Layout plan of premises
  • Project Report
  • Undertaking
  • Rent agreement or ownership proof (allotment letter, lease deed, sale deed)

Step 3: DPCC registration procedure for opening mall

  1. Drafting of Documents

Filing of application is important but without proper drafting of application, it is impossible. Therefore with the guidance and help of a consultant, you may draft the documents that shall be submitted on the online portal of DPCC.

  1. Filing of Application i.e. Consent To Establish

To start your mall, the first and the primary application to be filed with the State Pollution Control Board is Consent to Establish (CTE).  The filing of CTE is to be done online. Having a professional appointed will help you in drafting and filing of the application and that too hassle-freely.

  1. Filing of Lab Testing for effluent discharge

A lab testing report is necessary to analyze and fulfill the requirement of pollution control device for Effluent.

  1. Filing of Consent to Operate for malls/shopping complex.

For starting your mall you will be needing an approval from the state pollution control board. If you are Delhi-based then, DPCC shall grant Consent to Operate which shall be valid for 5 years and can be renewed in future.

  1. Inspection conducted by the officer in charge of the department

An inspector is assigned by the department that looks into the documents submitted by an applicant. After verifying all the documents, the DPCC license Is granted. And in case of any wrong information submitted by applicant, the application for registration shall be rejected.

  1. Issuance of Pollution License

When the officer gets satisfied with the proper and valid documentation, the designated officer then grants the authorization certificate to the applicant for starting with the mall.

Under Category II(a), the DPCC certificate may be granted within 30 days from the date of the receipt of the application submitted. And the deciding authority for the same is :

A committee comprising of:

  • Chairman, DPCC – Chairman
  • Member Secretary, DPCC – Member
  • S.K Gupta, Professor, IIT, Delhi-Member
  • C.R Babu, Prof Emeritus (CEMDE), University of Delhi-Member
  • Anil Kumar, Director DOE- Member
  • All SEEs of concerned Cell-Member
  • All EEs of concerned Cell-Member

Under Category II(b), the DPCC certificate may be granted within 30 days from the date of the receipt of the application submitted. And the deciding authority for the same is:-

A committee comprising of:

  • Member of Secretary, DPCC-Chairman
  • All SEEs of concerned Cell-Member
  • All EEs of concerned Cell-Member

For setting up housing complexes, commercial complexes & office complexes IT and infrastructure and Town Development Projects, the fee structure varies upon the total building area (sq.m).
